If you are a rights owner with a registered patent or are authorized by the patent owner to act on its behalf, you may report allegedly infringing listings via Wish’s “Report IP Violations” online form.
Please note, for patent infringement claims, we are unable to determine the validity of a claim of infringement based solely on pictures in merchant product listings. Thus, if you are the patent owner and you believe that someone is infringing on your patent, please report the allegedly infringing listing and provide, with the notice, a detailed claim chart outlining your claims of infringement and/or a court order concluding that the items are infringing.
A complete patent notice must include the following information:
- Full legal name, and a physical or electronic signature of the patent holder or its authorized representative.
- Contact information of the patent holder or its authorized representative.
- Valid patent registration.
- Court order/detailed claim chart.
- Identification of the material that is claimed to be infringing (Wish URL).
- A statement that the notifier has a good faith belief that the material identified is not authorized by the patent owner, its agent, or the law. And
- A statement made under penalty of perjury that the information provided is accurate and that the notifying party is authorized to make a complaint on behalf of the patent owner.
If the notice is incomplete and/or requires additional validation, Wish’s Brand Protection team may contact the notice provider and request missing and/or additional information. including, but not limited to: government-issued photo ID, business license, proof of intellectual property, and any other information reasonably necessary to process the notice. Upon receipt of additional information, we will reevaluate the notice.
Note, if you are an authorized representative and acting on behalf of the intellectual property right owner to report an allegedly infringing listing, you are required to submit a power of attorney or an authorization letter appointing you as a designated enforcement representative.
