An EU Registered Community Design is a form of intellectual property specific to the European Union. It is registered with the European Union Intellectual Property Office (EUIPO), to provide protection within the countries of the European Union. The European Union’s regulation defines a “design” as “the appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colors, shape, texture and/or materials of the product itself and/or its ornamentation.” In order to obtain an EU Registered Community Design, a design must be new or different from the previous designs and possess individual character.
An EU Registered Community Design grants an exclusive right to the rights holder to use, and prevent any third-party from using, the design within the EU.
