If you are a rights owner with a registered EU Community Design, or are authorized by the owner to act on its behalf, you may report allegedly infringing listings via Wish’s “Report IP Violations” online form.
Note, in order for us to review your request, the design must be new, unique, and possess individual character. If we were unable to determine that the design is new, unique, and possesses individual character, we will not be able to proceed with the request. If your request cannot be completed, you may provide us with additional evidence to support your claims and, upon receipt of additional evidence, we will reevaluate the notice.
A complete EU community design notice must include the following information:
- Full legal name, and a physical or electronic signature of the EU community design holder or its authorized representative.
- Contact information of the EU community design holder or its authorized representative.
- Valid EU community design registration.
- Identification of the material that is claimed to be infringing (Wish URL).
- A statement that the notifier has a good faith belief that the material identified is not authorized by the community design owner, its agent, or the law. And
- A statement made under penalty of perjury that the information provided is accurate and that the notifying party is authorized to make a complaint on behalf of the community design owner.
If the notice is incomplete and/or requires additional validation, Wish’s Brand Protection team may contact the notice provider and request missing and/or additional information, including, but not limited to: government-issued photo ID, business license, proof of intellectual property, and any other information reasonably necessary to process the notice. Upon receipt of additional information, we will reevaluate the notice.
Note, if you are an authorized representative and acting on behalf of the intellectual property right owner to report an allegedly infringing listing, you are required to submit a power of attorney or an authorization letter appointing you as a designated enforcement representative.
